Meditation can play a unique role in reducing litigation: Chief Justice

News Desk: Chief Justice Syed Mahmud Hossain has asked the judges, lawyers and those involved in the trial to be interested in settling the case through mediation.

He further said that all the aspirants are entitled to get speedy and fair trial. In that case, the mediation process can play a unique role in resolving the case by settling the case quickly.

He was speaking as the chief guest at a ceremony to award certificates to 280 judges trained across the country at the Hotel Intercontinental in the capital on Saturday (October 23rd).

The training and certification ceremony was organized by Bangladesh International Mediation Society (BIMS).

The Chief Justice said that in the mediation system, any grievance is settled through a mediator. Where the solution to the problem is found through the participation of both parties. As a result, it is possible to reach a decision with the consent of both the parties. It works to relieve litigation from the judiciary and to determine equality in justice.

The Chief Justice said mediation was being successfully applied in civil and criminal cases in Canada and the United States. At present, 10 percent of civil cases in New York are being settled through mediation at various stages of the trial. In Canada, about 80 percent of cases are settled this way. There has also been an emphasis on mediation in Australia.

Senior Judge of the Appellate Division of the Supreme Court of Bangladesh Mohammad Iman Ali, recipient of the International Mediation Award, presided over the function. Advocate SN Goswami, Chairman, Bangladesh International Mediation Society (BIMS) delivered the welcome address.

Former Indian Supreme Court Justice Kurien Joseph, former Chief Justice of Jammu and Kashmir Geeta Mital, UN Ombudsman Dr. Kevin Berry Brown, Senior District and Sessions Judge Sheikh Mofizur Rahman, Senior District and Sessions Judge Fazle Khoda Mohammad Nazir, Senior District and Sessions Judge Jayshree Samaddar and Chairman of Bangladesh India Mediators Forum George Yeshu Fida Victor.

Also present at the time was the High Court Justice of the Supreme Court. Mojibur Rahman Mia, Justice Zafar Ahmed and Justice Ahmed Sohel. The names of 6 people for the International Mediation Award 21 were announced at the ceremony.
