Nahid appeals to the Appellate Division seeking cancellation of BNP’s Qayyum’s candidacy

Nahid Islam, the candidate of the 11-party alliance and convener of the National Citizen Party (NCP), has filed an application with the Appellate Division challenging the order that dismissed his writ petition seeking the cancellation of the candidacy of BNP-nominated candidate Dr. M A Qayyum for the Dhaka-11 constituency, on allegations of dual citizenship and concealment of information.

On Saturday (8 February), Nahid Islam’s lawyer, Advocate Jahirul Islam Musa, confirmed the matter to the media.

He said that the hearing on the application may take place tomorrow (Sunday) in the court of the chamber judge.

Earlier, on 3 February, the High Court summarily dismissed Nahid Islam’s writ petition that challenged the legality of the candidacy of BNP-nominated candidate Dr. M A Qayyum for Dhaka-11 on allegations of dual citizenship and concealment of information. The order was passed by a High Court bench comprising Justice Fahmida Kader and Justice Md. Asif Hasan.

At the hearing, lawyers Mohammad Hossain Lipu and Advocate Jahirul Islam Musa appeared on behalf of the writ petitioner, while Advocate Ahsanul Karim, Barrister Ruhul Quddus Kajol, Advocate Mahbubur Rahman Khan, and Barrister Kazi Akhtar Hossain represented Dr. Qayyum.

On 2 February, a writ petition was filed by Nahid Islam challenging the legality of Dr. M A Qayyum’s candidacy for the Dhaka-11 constituency on allegations of dual citizenship and concealment of information. The petition sought a stay on Dr. Qayyum’s candidacy and named the Chief Election Commissioner and others as respondents.

Previously, the Election Commission had declared the nomination papers of both the 12-party alliance candidate and NCP convener Nahid Islam, and the BNP-nominated candidate and the party’s Microcredit Affairs Secretary, Dr. M A Qayyum, to be valid for the Dhaka-11 constituency.
