
Pabna Correspondent: Roy Uddin and Santesh Pramanik sold the land in the 27th century, crop land at daga number 663. The buyer's descendants were also occupying the land of that daga. After 38 years, when they came to cancel the rent of that land, they found out that the daga number in the document was mistakenly listed as daga number 677. Which is the land of the seller Roy Uddin's house.
Now the buyer's descendants are demanding the land of the house at daga number 677 in the document as the value of the land has increased. In this regard, the owner of the land, Roy Uddin, filed a case in the court and got the daga number corrected in the document and got the title deed. But the buyer did not agree and instead filed a case against them and harassed them in various ways. Now, the centenarian Roy Uddin and his son Ashraful Islam are going door to door in the hope of justice.
The victim Roy Uddin is a resident of Jaberpur village in Mathurapur union of Chatmohar upazila of Pabna. His son Ashraful Islam is a very poor painter. The accused are Amir Hossain, Abdul Alim and Monirul Islam, residents of the same village. They are the grandsons of the land buyer Afsar Sheikh.
After reviewing the land documents and papers, it was revealed that Raich Uddin and Santesh Sheikh sold 27 acres of crop land at plot number 663 of Uthuli Mouza to Afsar Sheikh and Asia Begum of the same village on 12/01/1976. During the land registry, the then document writer mistakenly mentioned plot number 677 instead of plot number 663 of the sold land. No one could have known about this at that time because both the buyer and the seller did not inform the school. After occupying the crop land at plot number 663 for 38 years, Afsar Sheikh came to know that plot number 677 was mentioned in the document instead of plot number 663. By that time, the price of the house land had also increased several times.
At that time, Afsar Sheikh misrepresented the matter to Chatmohar AC Land. There he claimed that they bought land at plot number 677. It is also mentioned in the document. Therefore, the land purchased at that plot number should be registered in their name. Then, after receiving the notice of the miscase, Ashraful, son of Raich Uddin, told the plaintiffs of the miscase, that the plot number in the document is wrong, you correct the document. I will do it. Because my father and their great uncle are alive. Because even if they want, they will not get 27 acres of land at plot number 677. The land in this plot is 41 acres in total. Out of that, Raich Uddin's land is 13 and a half acres. The rest of the land belongs to other heirs. The land rent in Raich Uddin's name was dismissed on 30/11/2008. Its account number is 799. Registration case number is 1490/08-09.
Raich Uddin's son Ashraful Islam said, "But they did not accept that, so I went to the then Naib Kashem Ali of the Chatmohar Municipal Land Office with a notice of miscase. When I asked him about the matter, he spoke in their favor without seeing my documents or listening to me and canceled the rejection of my father Raich Uddin's name.
Then Raich Uddin and Santesh Pramanik filed a case for document correction in the Pabna court on 02/01/2014. After the evidence, they got a degree in the case on 28/11/2029 based on the Dotorfa formula. In that degree, the court ordered, 'The wrong mark number 677 was deleted from the document number 1646 mentioned in the sold schedule on 12/01/1976 and the mark number 663 was corrected in its place. A copy of this order was sent to the concerned sub-registrar for taking necessary action.'
Then on 21/10/2024, Raich Uddin and his son Ashraful Islam went to the AC Land office with the revised documents and papers and filed a miscase. Afsar Sheikh's grandson Amir Hossain, Abdul Alim and Monirul Islam were named as defendants. After filing the miscase, Chatmohar Municipal Land Office Union Land Assistant Officer Mustafa Shamim conducted an on-site investigation of the miscase and submitted a report to AC Land on 24/02/2025. In that report, he mentioned, 'After hearing both sides and verifying the documents, 0.27 acres of land can be deducted from the open account number 1378 called name transfer number 4996/2016-17 and registered in the main ledger at the complainant RS 864 (whose SA number is 677).'
Raich Uddin's son Ashraful Islam said, 'On February 25, 2025, a hearing was held for both sides at the Chatmohar AC Land office. But AC Land Sahib, without seeing any of our documents, said that the defendant has appealed to the court. He dismissed the miscase saying that he had nothing to do with me.'
Ashraful Islam said that the defendant Amir Gong has appealed to the court against our degree of document correction. They have claimed the number 677 instead of the number 663 in the document. Earlier in 2017, when the notice was given to the Mathurapur Union Council to sit in arbitration three times, Amir Hossain Gong did not appear and did not sign the notice.'
A certificate signed by the then UP Chairman Sardar Md. Azizul Haque mentions that 'Raich Uddin's residence is located at the number 677 and 864. The number 677 was mistakenly included in the document of Afsar Sheikh. Land at plot number 663 is being occupied by 60-year-old Afsar Sheikh.'
Ashraful Islam, son of Raich Uddin, also said, 'Even though I gave the information slip from the court to get a degree and the certificate of the UP chairman to AC Land Sir, he did not accept it. I think they have disrespected the court by not looking at my documents and not following the court order. I want my justice. Why do we have to go door to door despite having all the information, evidence, documents and documents in my favor? My father is over a hundred years old. He is also very broken, just shedding tears. The defendant Amir Gong is an influential, wealthy man in the area. They have challenged that they will take our house land at plot number 677 at any cost. Now if they repeatedly file cases and harass me, won't the AC Land administration see it?'
The centenarian Raich Uddin said, 'I did not sell the land at plot number 677. I am selling it at plot number 663. They have been occupying the land for 38 years and are claiming the land of my house. At that time, everyone was stupid, no one knew how to read. They made a mistake and put the number 677 on the document. We have also corrected it in court. So why are they not accepting it? Will we get justice after all this?'
Accused Amir Hossain said, 'They have rejected the land by making fake documents. They have bought and sold land on all the marks. When my grandfather Afsar Sheikh registered the land in our name in 2014, I came to know about it while rejecting the land. Their inheritance is not land, but purchased property. They were asked to sit in arbitration to resolve the issue through discussion, but they did not sit. We have appealed to the court against the degree. Now whatever happens through the law will happen. There is no point in talking much about it now.'
In this regard, Chatmohar Upazila Assistant Commissioner (Land) Mehdi Hasan Shakil said, "If any of the plaintiffs or the defendants are not satisfied with my verdict, then they can appeal to the Additional Deputy Commissioner (Revenue) after receiving a copy of my verdict. Then if the ADC sir calls for documents from me if necessary, I will provide all the documents of my verdict to him."
Aceland also said, "If there is an appeal against any other case, the main case will remain ongoing. If the defendant (Amir Gong) appeals against the degree of their (Roich Uddin Gong) case, then that case will now be considered ongoing. So everyone will have to wait until the verdict is given. The court will decide who is wrong and who is right."
